TERMS & CONDITIONS

1. Scope

These Terms & Conditions govern the use of the website and the sale of products and services by

Vaida Schiavo Design ( we , us , our ) to consumers and business customers ( you ).

2. Products & Services

We design and sell couture and bridalwear, including made-to-measure and made-to-order

garments, accessories, alterations, fittings, and trunk show appointments. Images are

illustrative; artisanal production may cause slight variations.

3. Contract Formation

Our offers are non binding. A contract is concluded when we confirm your order in writing

(e.g., email) or by dispatching goods / scheduling services after receiving any required

deposit.

4. Prices, Taxes & Payment

Prices are shown in the currency indicated on the site; shipping, duties and taxes may apply.

For couture, a non refundable deposit (typically 50 70%) is due at order; the balance is

payable before collection/delivery. Accepted payment methods are shown at checkout or in the

order confirmation.

5. Lead Times & Fittings

Timeframes are estimates. You agree to provide accurate measurements, timely approvals, and to

attend fittings. Delays caused by missed appointments or late approvals may shift delivery

dates.

6. Delivery & Transfer of Risk

Shipping options and costs are shown at checkout. Risk transfers upon delivery to you or your

designated recipient; for in studio collection, upon hand over.

7. Right of Withdrawal (EU Consumers; Distance Contracts for Standard Goods Only)

You have a 14 day withdrawal right from receipt for standard (non custom) goods purchased

online. No withdrawal right applies to goods made to your specifications or clearly

personalized (e.g., made to measure gowns) pursuant to Section 312g(2) No. 1 BGB (Germany).

8. Returns & Exchanges

Standard goods: see Section 7. Custom/made to measure items are final sale; statutory warranty

remains unaffected.

9. Alterations

Alterations requested after the final fitting may incur additional charges. Significant

body measurement changes after order may require pattern adjustments or remakes at your cost.

10. Warranty

Statutory warranty rights apply. Wear and tear, improper care, and unauthorized alterations are

excluded. Please notify us of defects without undue delay.

11. Appointments, No Shows & Cancellations

We may require a booking fee. If you miss or cancel an appointment late, the fee may be

forfeited or a no show charge may apply, as displayed during booking.

12. Events & Trunk Shows

Dates, locations, and capacities are subject to change. Access may be limited or events

rescheduled (e.g., force majeure, safety).

13. Intellectual Property

All designs, patterns, photographs, videos, text, logos, and trademarks are our property or

used under license. Any use beyond contractual permissions requires prior written consent.

14. Image & Likeness

We publish identifiable client imagery only with consent. We may share anonymized details or

craftsmanship close ups unless you object in writing.

15. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or

health, and under product liability law. For simple negligence, we are liable only for breaches

of material contractual obligations and limited to foreseeable, typical damage.

16. Export & Import

You are responsible for compliance with import laws, duties, and taxes in your destination

country.

17. Governing Law & Jurisdiction

German law applies (excluding CISG). Mandatory consumer protections of your habitual residence

remain unaffected. Exclusive venue for merchants is Stuttgart, Germany.

18. Changes to the Terms

We may amend these Terms. The version effective at the time of contract applies to that order.

19. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g.,

natural events, strikes, epidemics, governmental actions).

20. Assignment, Severability, No Waiver

We may assign rights/obligations where your statutory rights remain unaffected. If any

provision is invalid, the remainder remains effective. Failure to enforce a provision is not a

waiver.

WITHDRAWAL INFORMATION & MODEL FORM

Withdrawal Information (Standard Goods Distance Sales Only)

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without giving any

reason. The withdrawal period expires fourteen days from the day on which you or a third party

indicated by you acquires physical possession of the goods.

Exclusion of Withdrawal

There is no right of withdrawal for goods that are not prefabricated and are made on the basis

of an individual choice or decision by you, or which are clearly personalized (including

made to measure gowns), pursuant to Section 312g(2) No. 1 BGB (Germany).

Effects of Withdrawal

If you withdraw, we shall reimburse all payments received from you without undue delay and in

any event not later than fourteen days from the day on which we are informed of your decision

to withdraw. We will make the reimbursement using the same means of payment as you used for the

initial transaction, unless expressly agreed otherwise. We may withhold reimbursement until we

have received the goods back or you have supplied evidence of having sent back the goods.

Return of Goods

You shall send back the goods without undue delay and in any event not later than fourteen days

from the day on which you communicate your withdrawal. You bear the direct cost of returning

the goods unless otherwise stated. You are liable for any diminished value resulting from

handling other than what is necessary to establish the nature, characteristics and functioning

of the goods.

2. Personal Data We Process

Website data: server logs (IP address, timestamp, URL, referrer, user agent), essential

cookies.

Orders & appointments: contact details, billing/shipping addresses, measurements (for

made to measure), order/payment data, communications.

Marketing (optional): newsletter subscriptions and engagement (with consent).

Embedded media/social: When you interact with embedded services (e.g., Instagram/YouTube),

those providers process data as independent controllers.

3. Purposes & Legal Bases (Art. 6 GDPR)

Contract performance (Art. 6(1)(b)): order processing, fittings, delivery, customer service.

Legal obligations (Art. 6(1)(c)): tax, accounting, compliance.

Legitimate interests (Art. 6(1)(f)): IT security, fraud prevention, privacy friendly

analytics, anonymized craftsmanship showcases.

Consent (Art. 6(1)(a)): newsletters, non essential cookies, publishing identifiable client

images (withdrawable at any time).

4. Cookies

We use essential cookies. Statistics/marketing cookies run only with your consent via the

cookie banner. You can change preferences anytime via Cookie Settings .

5. Recipients & International Transfers

We use processors under Art. 28 GDPR (hosting, email, payments, logistics, optional

booking/newsletter tools). Transfers outside the EEA rely on adequacy decisions or Standard

Contractual Clauses plus supplementary measures where required.

6. Retention

Order and tax records are generally retained 6 10 years; appointment data while active;

marketing data until you unsubscribe or withdraw consent.

7. Your Rights

Access, rectification, erasure, restriction, data portability, objection (Arts. 15 21 GDPR) and

withdrawal of consent. You may lodge a complaint with your supervisory authority; in

Baden Württemberg: Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit.

8. Children

Not directed to children under 16 without required consent.

9. Security

We implement appropriate technical and organizational measures to protect personal data.

10. Changes

We may update this Privacy Policy; the latest version applies.
